Certainbiologicalcontrolagentsareexempt(exceptforeucaryoticmicroorganisms,includingprotozoa,algae,andfungi;procaryoticmicroorganisms,includingbacteria;andviruses).

AlllivingplantsintendedforuseasbiologicalcontrolagentsareexemptfromtherequirementsofFIFRA.However,plant-incorporatedprotectantsarenotexemptpursuanttothissection.Regulations,includingexemptions,forplant-incorporatedprotectantsareaddressedin40CFRPart174.
